1. Acceptance of these terms

By accessing or using Milkdrop, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the website or submit information through it.

2. Milkdrop is not medical advice

Milkdrop provides general educational information about breast-milk donation, screening, and related services. Website content is not medical, legal, nutritional, lactation, or other professional advice, and it does not create a provider-patient relationship. Always consult a qualified healthcare professional for questions about you, your child, lactation, medication, nutrition, or health.

3. Eligibility and donor-program participation

Completing an eligibility tool or application does not guarantee acceptance into the Milkdrop donor program, compensation, a kit, screening approval, or any particular outcome. Eligibility, participation, screening, compensation, and program requirements are determined under the separate donor consent, donor agreement, program documents, and applicable law.

If you are accepted into the donor program, you may be asked to complete separate agreements, authorizations, acknowledgements, and consent forms. Those documents control if they conflict with these Terms regarding the donor program.

4. Your information and account security

You agree to provide accurate, current, and complete information when using Milkdrop. If you create or receive portal credentials, you are responsible for maintaining their confidentiality and for activity occurring through your account. Notify us promptly at support@itsmyleche.com if you believe your account has been accessed without authorization.

5. Acceptable use

You may use Milkdrop only for lawful, personal, non-commercial purposes. You may not:

• Provide false, misleading, fraudulent, or incomplete information.
• Attempt to interfere with, disrupt, compromise, or gain unauthorized access to the website, portal, accounts, or systems.
• Use bots, scrapers, data-mining tools, or other automated means to access the website without our written permission.
• Impersonate another person or misrepresent your affiliation with any person or organization.
• Use the website in violation of applicable law or another person’s rights.

6. Intellectual property

Milkdrop and its content—including text, designs, logos, trademarks, images, video, graphics, and site functionality—are owned by or licensed to It's My Leche, Inc. and are protected by applicable intellectual-property laws. We grant you a limited, revocable, non-transferable right to use the website for its intended personal purpose. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from Milkdrop content without our prior written permission.

7. Feedback and content you submit

If you submit feedback, ideas, or non-confidential content to us, you represent that you have the right to submit it. Unless we agree otherwise in writing, you grant us a worldwide, royalty-free, non-exclusive license to use that feedback to operate, improve, and promote our services. We will obtain separate written permission before using identifiable donor, baby, or family stories or images in public marketing where required by law or our policies.

Milkdrop may link to or use third-party services, including social platforms, analytics providers, and the donor portal. These services are governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, content, or practices.

9. Disclaimers

Milkdrop is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. We do not promise that Milkdrop will be uninterrupted, error-free, or free of harmful components, or that all website content will always be complete or current.

10. Limitation of liability

To the fullest extent permitted by law, It's My Leche, Inc. and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption, arising out of or related to your use of or inability to use Milkdrop. Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless It's My Leche, Inc. and its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses arising from your violation of these Terms, misuse of Milkdrop, violation of law, or infringement of another person’s rights.

12. Governing law and venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Except where applicable law requires otherwise, disputes arising from these Terms or Milkdrop will be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to that jurisdiction and venue.

13. Changes to these terms

We may update these Terms from time to time. Updated Terms are effective when posted on this page unless otherwise stated. Your continued use of Milkdrop after an update means you accept the updated Terms.
